Refinery Project Moves To New Site

PHOENIX, AZ
(Feb. 4, 2008) – Arizona Clean Fuels Yuma (ACFY) is moving
the site of its oil refinery project three miles east of the current
site in Yuma County, AZ. The move resolves legal uncertainties surrounding
a lawsuit by the Quechan Indian Tribe in April of 2007.
The Quechan
Tribe, located 45 miles west of the original project site, challenged
the transfer of approximately 40,000 acres of land from the Federal
Government to the Wellton Mohawk Irrigation & Drainage District
which included the refinery site. Although all rulings to date on
the lawsuit have been in favor of the federal government and other
defendants, including ACFY, the uncertainty on when it will ultimately
get resolved is a concern for ACFY.

the project will now be outside the 40,000 acre area named in federal
court and on land not subject to this kind of legal challenge, it
can now proceed as planned” said Glenn McGinnis, CEO of Arizona
Clean Fuels Yuma. “We are pleased to report to the citizens
of Arizona and Yuma County, who overwhelmingly support this project,
that we are moving forward and are one step closer to bringing a
$3.2 billion dollar capital investment to the area.”
ACFY is working
with the Wellton Mohawk Irrigation and Drainage District, the Arizona
State Land Department and the Arizona Department of Environmental
Quality to finalize logistical issues created by the move. Based
on current scheduling, basic engineering for the project will be
completed in early 2009, with major construction work beginning
in the second quarter of 2009.
Arizona Clean
Fuels Yuma LLC (ACFY) is an Arizona-based company planning to build
a state-of-the-art 150,000 barrel per day oil refinery to produce
gasoline, diesel and jet fuel to serve Arizona’s growing population.
ACFY received a Class 1 Title V Operating Permit on April 14, 2005,
making it the first new refinery permitted to operate in the United
States in over 30 years. The facility will comply with stringent
